1. Definitions
Company: refers to Al Madinah Al Munawwarah LLC, the owner and operator of freight, passenger transportation, customs clearance, and aircraft brokerage services.
Customer: any individual or company using the Company’s services.
Shipment: any package or goods transported or cleared by the Company at the request of the Customer.
Passenger: any person using the transportation services provided by the Company.
Seller and Buyer: any party dealing with the Company in the context of brokering the sale of aircraft.
Agreement: means these terms and conditions governing the relationship between the Company and the Customer, Passenger, or any third party dealing with the Company.
2. Use of the Service
The Customer must be of legal age to benefit from the Company’s services.
The Customer must provide accurate information when booking or submitting requests, and update it as necessary.
The Company reserves the right to refuse to provide service to any person or entity that does not comply with these terms.
3. Passenger Transport Terms
The passenger is obligated to pay the agreed fare before or during the trip.
Smoking or consuming alcoholic beverages is not permitted inside the vehicles.
The Company has the right to refuse to transport any passenger carrying prohibited materials or suspected of illegal behavior.
The Company is not responsible for personal items lost inside the vehicle after the trip has ended.
4. Shipping Terms
The customer is responsible for packing the parcels securely in accordance with shipping requirements.
Flammable materials, weapons, narcotics, or any goods prohibited by local laws may not be shipped.
The Company is not responsible for any delay resulting from circumstances beyond its control (such as weather conditions or customs procedures).
The customer has the right to request additional insurance on the shipment for an additional fee.
5. Customs Clearance
The Company provides customs clearance services on behalf of customers in accordance with local and international customs laws and regulations.
The customer is obligated to provide all documents required for the clearance process, such as commercial invoices, certificates of origin, and necessary licenses.
The company is not responsible for any delay resulting from incomplete customs documents or procedures.
The customer bears all customs duties and taxes due on the shipment.
The company has the right to refuse to clear any shipment containing illegal or prohibited goods according to customs regulations.
6. Aircraft sales brokerage
The company provides brokerage services between sellers and buyers of aircraft, whether commercial or private.
The company provides aircraft evaluation services, technical inspection, and price negotiation between the parties concerned.
The seller is obligated to provide correct and complete information about the condition of the aircraft, maintenance history, and accident record (if any).
The company is not responsible for any legal dispute between the seller and the buyer after the transaction is completed.
The brokerage fees are collected at an agreed percentage of the final sale value, and are paid upon signing the contract.
The company reserves the right to reject any sale or purchase that does not comply with legal or ethical standards.
7. Service Cancellation and Refund
Customers may cancel reservations or orders at least 24 hours before the execution date to receive a full refund.
In the event of cancellation within less than 24 hours, a cancellation fee of up to 50% of the service value may be deducted.
If the customer does not show up at the time of pick-up or boarding, the reservation will be considered cancelled without a refund of the amount paid.
8. Liability and Warranty Limits
The company is not responsible for any delay or loss of shipments resulting from force majeure (such as natural disasters or government decisions).
The company is not responsible for any injuries or damages to passengers or goods due to the customer’s negligence or failure to comply with instructions.
The company has the right to compensate customers in the event of damage or loss in accordance with the approved compensation policy.
In aircraft brokerage services, the company is not responsible for any legal or operational problems of the aircraft after the transaction is completed.
9. Complaints and Dispute Resolution
Customers can submit a complaint via customer service within 48 hours of the problem occurring.
The company will make every effort to resolve complaints within 7 working days.
In the event of a dispute, arbitration or the competent legal authorities in the country in which the company is registered will be resorted to.
10. Amendments to the Terms and Conditions
The company reserves the right to amend these terms and conditions at any time, and customers will be notified of the amendments via email or the company's website.
